Terms of Service
Civexa AI is a service operated by MINAC GROUP LLC, a Washington limited liability company ("Civexa," "we," or "us"). By accessing or using Civexa ("the Service"), you agree to these Terms. Please read them carefully. If you do not agree, do not use the Service.
1. What Civexa is
Civexa provides planning-level development feasibility screening estimates based on public data and published municipal code. Reports are informational tools, not appraisals, surveys, engineering assessments, legal advice, or official determinations of any kind.
2. No reliance; no professional advice
Civexa's outputs are estimates that may contain errors or omissions and may not reflect the most current code, site conditions, or jurisdictional interpretation. You agree not to rely on any Civexa report as the basis for a purchase, financing, design, or development decision without independent verification by qualified professionals and the relevant jurisdiction. Civexa is not a substitute for an architect, engineer, surveyor, attorney, or the permitting authority.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and promptly update it as needed.
4. Payments and credits
Reports are sold individually or via subscription. Credits and subscriptions are licenses to generate reports and are non-transferable. Except where required by law or expressly stated, payments are non-refundable. Subscription plans renew automatically until cancelled.
5. Acceptable use
You may not misuse the Service, attempt to circumvent usage limits, scrape or resell outputs at scale, or use the Service in violation of any law.
6. User-generated content
"User Content" means anything you submit to the Service — including the addresses, parcels, and project inputs you enter, saved searches, and any feedback, comments, or other materials. You retain ownership of your User Content. By submitting it, you grant Civexa a worldwide, non-exclusive, royalty-free license to host, store, process, and use it to operate, secure, and improve the Service.
You are solely responsible for your User Content and represent that you have the rights to submit it and that it does not infringe any third party's rights or violate any law. You may not submit content that is unlawful, infringing, deceptive, or that you are not authorized to share. Civexa does not pre-screen User Content and is not responsible for it, but may remove or disable any content, or suspend accounts, at its discretion. To report content or a copyright concern, contact contact@civexa.us.
7. AI-assisted and automated content
Civexa uses automated systems and artificial intelligence to generate reports. Zoning interpretations, unit counts, buildable-envelope figures, cost estimates, and report narrative are produced by software and AI models from public data and code references. They are planning-level estimates, generated automatically, and may contain errors or omissions. They are not appraisals, surveys, engineering, legal, or official determinations, and no human professional has certified them. Always verify figures with the local jurisdiction and qualified professionals before relying on them or making any decision.
8. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.
9. Limitation of liability
To the fullest extent permitted by law, Civexa and its operators shall not be liable for any indirect, incidental, consequential, or special damages, or for any decision made or action taken in reliance on a report. Total liability for any claim shall not exceed the amount you paid for the report(s) giving rise to the claim.
10. Dispute resolution — binding arbitration & class-action waiver
Please read this section carefully — it affects your legal rights. You and Civexa agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration, rather than in court, except that either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court for intellectual-property or unauthorized-access claims.
The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before a single arbitrator, seated in King County, Washington (or, by mutual agreement, conducted remotely). Washington law and the Federal Arbitration Act govern.
Class-action and jury waiver: disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. You and Civexa waive any right to a jury trial.
30-day opt-out: you may opt out of this arbitration agreement by emailing contact@civexa.us within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration.
11. Governing law
These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules. Subject to the arbitration section above, the state and federal courts located in King County, Washington have exclusive jurisdiction over any matter not subject to arbitration.
12. Changes
We may update these Terms from time to time. Continued use after changes constitutes acceptance of the revised Terms.
